The parties agree that the Contractor shall perform the following services at the site of the property indicated within the approved estimate.
Contractor is on-call 24/7 from November 1st to March 31st and will service property upon 2 inches or more of snow accumulation.
The Contractor shall attend at the premises to apply ice melting products to the premises in accordance with freezing conditions.
The Contractor will attend to apply ice melting products to the premises once within a reasonable period following the request, having regard to the timing of the request and the volume of work the Contractor is otherwise committed to.
The Client acknowledges that ice melting products, which are not intended to provide traction, are freeze point depressants only, the effectiveness of which will depend on ground temperatures and weather conditions at, and following, the time of their application. The Client further acknowledges that the application of ice melting products will not and cannot result in the immediate or complete removal of ice or snow from the premises and the Contractor provides no guarantee or warranty that the application of ice melting products will be effective in eliminating ice or snow. The application of ice melting products is towards managing, but not eliminating, the risks associated with snow and ice.
In extreme situations supplier shortage of ice melt, dirt may be used as supplement.
Residential Customer- Season down-payment is required for 24/7 contractor availability. Invoice is sent by automated email and electronic payment collected upon receipt of service/ end of snow event.
Business / HOA / Commercial- Invoice is sent by email on the last day of the month and payment and collected within ten (10) business days.
Tiered pricing per inches of snow, increase 50% of estimate over 4 inches of snow.
EXAMPLE:
$40 (2- 4 inches of snow cleared)
$60 (4.1- 6 inches of snow cleared)
Six or more inches of snow generally require repeat visit.
Ice management pricing is a per application event outlined in estimate.
Should the Client fail to make payments as they become due, an interest at twelve percent (12%) late fee after 30 days overdue and is at risk for cancellation of services from contractor.
Under no circumstances will either Party be liable for any indirect, special, consequential, or punitive damages (including lost profits) arising out of, or related to, this agreement or the transactions it contemplates (whether for breach of contract, tort, negligence, or other form of action) if such is not related to the direct result of one of the Parties’ negligence of breach.
All incidents resulting in actual, apparent or potential damage or injury must be reported to the Contractor as promptly as possible.
Any property including fences, light posts, patios etc., damaged by the Contractor will be restored to its original condition at Contractor expense.
The Contractor will be diligent in scope of work however held harmless from any bodily or property damaged due to snow or freezing conditions.
Notice to the company by email or phone call within 24 hours or more is required. If the Contractor is not notified within 24 hours of skipping routine service, the client will be responsible for the price of the appointment. Cancelation of services must be submitted in writing and can occur at any time within 24 hours of scheduled service. Service agreements will NOT be automatically renewed after term finished.
The Contractor agrees to carry out its work diligently and to provide sufficient supervision and inspection of its staff and subcontractors and that work will be of proper and professional quality, and in full conformity with the requirements of the contract.
The Contractor warrants that it is competent to perform the Work and that it has the necessary qualifications including knowledge and skill with the ability to use them effectively.
It is the responsibility of the Client or the Client’s representative to fully inform the Contractor of all the information regarding site unknowns that may include difficult buried materials, cables, and pipes, tree stumps, drainage or water table issues, rock and shale sub-surfaces and/or other impediments, issues or factors that could otherwise impact the quality, cost and timeliness of project completion.
